The topic of activist judges is probably more serious than we currently acknowledge. They are almost as bad as professors with tenure. They're like a festering pustule that needs to be disengorged. But there is no accountability to the American people. We must sit back and hope that they will be replaced someday. Meanwhile, they continue their poisonous inflammation.

Should we elect judges instead of appointing them?
Should we add their names to the ballot a few years after they've been appointed for review by the people? Then we would have the option to keep them or send them packing!
Maybe a higher turnover rate with a fear of being voted off the bench might help calm the activist tide that will certainly overun this country if unchecked.
Well, that's currently how we handle state judges in Utah.
ReplyDeleteAfter a certain term, each judge comes up on the ballot for an up-or-down vote. If a majority votes against him, he's out and will have to be replaced.
To be honest, I think the biggest problem is the people being put on the bench. In my humble opinion, the judiciary should be made up of strict originalist judges. (See Justice Scalia.) But that's me.
